PR Photography UK – Terms & Conditions

These Terms & Conditions apply to all photography, images, digital files, prints and other photographic content produced, supplied, displayed or made available by PRPhotographyUk/PRPhotographyMotorsport (“the Photographer”).

By accessing, viewing, downloading, purchasing or otherwise using images from the PRPhotographyUk/PRPhotographyMotorsport
  website or social media platforms, you agree to comply with these Terms & Conditions.

1. Copyright & Ownership

All photographs, images and photographic content displayed on this website, including but not limited to galleries, previews, thumbnails and social media content, are protected by copyright under applicable UK copyright law.

Unless expressly stated otherwise in writing, all copyright and intellectual property rights remain the property of PRPhotographyUk/PRPhotographyMotorsport

The purchase of an image does not automatically transfer copyright or ownership of that image. Purchasing an image provides the customer with the specific usage rights agreed at the time of purchase.

2. Personal Use

Images purchased for personal use may be used for private, non-commercial purposes, subject to any specific licence or restrictions provided with the purchase.

Personal use may include displaying an image privately, printing it for personal use, or sharing an image on personal social media accounts where no commercial, advertising or business purpose is involved.

The image must not be altered, edited, cropped in a manner that removes copyright information, or otherwise manipulated in a way that misrepresents the original work without the Photographer's permission.

3. Commercial & Business Use

No image displayed on the PR Photography Uk website or social media platforms may be used for commercial, advertising, promotional, sponsorship, marketing or business purposes without prior written permission from the Photographer and/or the appropriate commercial licence or image purchase.

Commercial use includes, but is not limited to:

  • Business websites
  • Company or business social media accounts
  • Advertising
  • Marketing campaigns
  • Promotional material
  • Sponsorship material
  • Posters, flyers and banners
  • Programmes, magazines and publications
  • Merchandise
  • Corporate communications
  • Paid advertising
  • Business or sponsor promotions
  • Use by teams, drivers, sponsors, manufacturers or other commercial organisations

Commercial usage may require a separate licence and/or fee depending on the intended use, distribution, duration and audience.

4. Screenshots & Website Previews

Images displayed on the PR Photography Uk website may contain watermarks, reduced resolution or other measures intended to protect the Photographer's copyright.

Taking a screenshot of an image does not grant permission to use that image.

Screenshots, screen captures, downloaded previews or other copies of images obtained from the website or social media are still protected by copyright.

A screenshot or website preview must not be used for commercial, advertising, promotional, sponsorship or business purposes without prior written permission.

Commercial use of screenshots

Where a screenshot, screen capture or website preview containing one of the Photographer's images is used for commercial, advertising, promotional or business purposes without prior permission, the use will be treated as an unauthorised commercial use of the image.

The Photographer reserves the right to invoice the person, business, organisation or other party responsible for the use at the full applicable commercial image/licensing cost, regardless of whether the image was obtained by screenshot, downloaded as a preview, copied from social media or otherwise reproduced.

The presence of a watermark or reduced-resolution preview does not make an image free to use.

5. Social Media Sharing

Sharing or reposting an image on a personal, non-commercial social media account may be permitted where the image has been purchased or where the Photographer has expressly allowed the sharing.

Where permitted, the Photographer should be clearly credited and the image must not be altered in a manner that removes or obscures the Photographer's branding, watermark or copyright information.

Businesses, teams, drivers, sponsors and other commercial entities should obtain the appropriate permission or licence before using images for business-related social media activity.

6. Purchasing Images

Payment for an image grants the purchaser the usage rights specifically associated with the product or licence purchased.

Different image products may carry different usage rights. A purchase of a personal-use digital image does not automatically provide commercial usage rights.

If you require an image for commercial, advertising, promotional or business purposes, please contact PR Photography Uk before using the image.

7. Unauthorised Use

Unauthorised reproduction, copying, downloading, distribution, publication, alteration or commercial use of any photograph may constitute copyright infringement.

Where an image has been used without the required permission or licence, the Photographer reserves the right to:

  • Request immediate removal of the image;
  • Request appropriate credit where applicable;
  • Invoice for the applicable image or commercial licence fee;
  • Seek compensation for unauthorised use;
  • Take further action to protect the Photographer's copyright where necessary.

The Photographer reserves all rights in respect of unauthorised use.

Requests for the removal of an image from the PR Photography Motorsport website must be submitted in writing via the official PR Photography contact page.

Requests made verbally, via social media comments, social media direct messages, text message or any other informal method will not be considered an official image removal request.

When submitting a removal request, please provide sufficient information to identify the image, including where possible:

  • The event or location;
  • The driver's name or vehicle;
  • The approximate date;
  • The gallery or page where the image appears;
  • The reason for the removal request.

PR Photography Motorsport will review written removal requests submitted through the official contact form and will determine whether the image can be removed.

Submission of a removal request does not automatically guarantee removal of an image. Copyright and ownership of the photograph remain with PR Photography Motorsport / the Photographer, and removal of an image from the website does not transfer or affect copyright ownership.

Where an image has already been purchased, licensed, published or supplied for an agreed purpose, removal from the website does not automatically cancel or invalidate any existing purchase or licence agreement unless otherwise agreed in writing.

 

8. Third-Party Use

You must not provide, sell, transfer, distribute or license an image purchased from PR Photography uk to another person, business or organisation for their commercial use unless expressly authorised in writing by the Photographer.

A customer purchasing an image for personal use cannot subsequently grant a business, sponsor, team or other commercial organisation permission to use that image commercially.

9. Copyright Notice

The absence of a visible watermark, copyright notice or other identifying information does not mean that an image is free from copyright protection.

All photographs remain protected by copyright regardless of whether they are displayed with or without a watermark.

10. Permission & Licensing

Any permission to use an image outside the permitted usage associated with a purchase must be agreed with the Photographer in writing.

Commercial licences may be subject to additional fees depending on:

  • Intended use;
  • Size and prominence of the image;
  • Duration of use;
  • Geographic distribution;
  • Print quantity;
  • Online audience;
  • Advertising spend;
  • Brand or organisation involved;
  • Exclusivity requirements.

11. Changes to These Terms

PR Photography Uk reserves the right to amend or update these Terms & Conditions when necessary. The current version published on the website will apply to future use of the website and its content.
